The Court of Appeal has granted the Independent National Electoral Commission (INEC) permission to reconfigure its Bimodal Voter Accreditation System (BVAS) for the Saturday Governorship and State Assemblies Elections.
A three-member panel of the appellate court, led by Justice Joseph Ikyegh, on Wednesday granted leave to the applicant for the purposes of configuring the BVAS for the coming elections, but asked INEC to upload data to back-end server and make true Certified copy to the respondents.
The court ordered INEC to allow the applicants to inspect and carry out digital forensic examination of all the electoral materials used in the conduct of the elections.
The panel however refused to grant the Labour Party candidate Mr Peter Obi’s application to scan and make copies of the election materials from INEC’s database, on the grounds that to do so will amount to obstructing the electoral body in carrying out its functions assigned to it by the 1999 constitution.
